Meyer Suozzi Prevails on Behalf of Professional Firefighters Association of Nassau County, Local 1588

Village of Garden City lost a Court Decision in New York State Supreme Court, Nassau County which rejected the Village of Garden City’s attempt to stop an arbitration challenging the termination of health insurance benefits of a Professional Fire Fighter who had been injured in the line of duty. On November 15, 2017, Hon. Robert A. Bruno denied the Village of Garden City’s motion to stay arbitration of a grievance by the Garden City Professional Fire Fighters, Local 1588, IAFF, AFL-CIO and ruled that the cited collective bargaining agreement provision, “although broadly worded, contains express language relating to the dispute at issue – whether disabled firefighters who are out on disability leave are entitled to the continuation of contractual health insurance benefits.” The Supreme Court, Nassau County and the Appellate Division, Second Department had previously denied the Village’s applications for a temporary restraining order seeking to stop the arbitration.
