A discussion of foreign issuers accessing U.S. capital markets and domestic issuers with significant assets outside the U.S. in a distressed scenario, in particular, in emerging markets. Examination of international insolvencies based on U.S. law-governed financing documents secured by foreign collateral in jurisdictions with new or untested insolvency regimes or those that don’t recognize U.S. court orders and use of U.S. or U.K. courts to assist.
